The FCC releases final draft of net neutrality repeal

09 January 2018, 12:41 | Ricardo Garza

The effort to block the FCC's repeal of net neutrality just hit an important milestone

Court Fight Over Net Neutrality Begins to Take Shape

The resolution doesn't have any Republican sponsors, making passage doubtful, but a floor vote could force Republican senators to publicly support the FCC's exceedingly unpopular move.

A Senate bill that would reverse the Federal Communications Commission's decision in December, received its 30th co-sponsor Monday, meaning that it will receive a vote, reports The Hill.

But net neutrality backers have argued that clear rules are needed to prevent internet service providers from blocking or throttling services or websites for competitive reasons, and that the rollback would increase the power of a few dominant providers to control what users see online. With the FCC's just-published order, net neutrality is no longer the law.

Thirty senators have now signed on to cosponsor a resolution that would nullify the repeal, MA senator Ed Markey announced Monday on Twitter.

Now the bill in the US Senate will get a vote to restore a Net Neutrality after 30 US Senators cosponsor a bill.

With the 30 votes, the CRA resolution will receive a full vote in the Senate. The Congressional Review Act, which allows lawmakers to review new federal rules before they go into action, provides for Congress to vote on new rules decided by federal agencies. Previously a seldom used, obscure law, the CRA was used multiple times by Congress a year ago to overturn regulations issued in the waning days of the Obama administration.

Getting a vote is only part of the battle. Even if it could be passed by both houses of Congress, it's likely President Donald Trump would stand with Ajit Pai, the FCC's chairman whom he appointed and who led the effort to repeal the net-neutrality rules, and veto the resolution.

If net neutrality protections pass in California, we'll be a model for other states, and make it harder for Comcast, Verizon, and other big telecom companies to justify anti-consumer schemes that violate net neutrality elsewhere in the country. However, it is going to force Republicans to take a highly unpopular vote in an election year if they don't choose to protect net neutrality. Including the more than 75% of Republican voters who support net neutrality? "IA intends to act as an intervenor in judicial action against this order and, along with our member companies, will continue our push to restore strong, enforceable net neutrality protections through a legislative solution".
