London's Great Ormond Street Hospital, which is caring for Charlie and has been seeking court permission to let him die since February, objected that a doctor proposed by the family on Wednesday lacked the right qualifications.

The latest legal row began when the hospital said it was not practical to get the equipment the child needs into the family home, as his ventilator is unable to fit through the front door.

Grant Armstrong, the lawyer for Ms Yates and Charlie's father Chris Gard, paid tribute to the nurses who have offered to help, working on their days off or between shifts.

The moral distress in Charlie's situation is palpable for Charlie's parents and also the health-care providers who continue to care for Charlie when treatment has been deemed futile.

Charlie suffers from mitochondrial depletion syndrome, a rare genetic disease.




"Unless by 12 noon tomorrow the parents and the guardian and the hospital can agree an alternative arrangement, Charlie will be transferred to a hospice and extubated shortly after", said Nicholas Francis, the judge presiding over the case. The hospital recommended a hospice, but said that life support would be withdrawn after a few hours, contrary to Chris and Connie's wishes of wanting days with their son.

Mr Armstrong said Great Ormond Street bosses were not satisfied that a properly qualified specialist would be in charge under the couple's plan.

He issued an order barring publication of the name of the hospice and the date when Charlie is taken there.

His parents have made the heartbreaking decision to abandon their fight with the hospital over whether life-support should be removed instead of him being allowed experimental treatment in America.

However, after new medical reports were revealed in court last week, Yates and Gard conceded that Charlie no longer has a chance for improvement, and on Monday withdrew their legal fight.

Following the hearing, Charlie's godfather James Evers accused GOSH of putting "arduous conditions" in the way of Ms Yates and Mr Gard's wishes. "Unfortunately, a MRI scan of Charlie's muscle tissue conducted in the past week has revealed that it is very unlikely that he would benefit from this treatment".
